New Hampshire Justice Charged for Allegedly Interfering in Investigation

In a shocking development, Associate Justice Anna Barbara Hantz Marconi of the New Hampshire Supreme Court has been indicted on multiple counts for allegedly attempting to influence an investigation involving her spouse. The indictment was handed down by a Merrimack County grand jury and announced on Wednesday by state authorities.

The Hill reported that authorities have charged Hantz Marconi with two felonies and five misdemeanors, highlighting a significant legal challenge for a sitting justice.

The charges against Hantz Marconi include two felony counts: one for attempting to commit improper influence and another for criminal solicitation of improper influence. Each of these felonies carries potential penalties of 3.5 to 7 years in state prison and a fine of $4,000.

Beyond the felony allegations, Hantz Marconi also faces five misdemeanor counts. These include two charges related to the criminal solicitation of misuse of position, among others like official oppression and obstruction of government administration. Each misdemeanor could lead to up to 12 months in a correctional facility and a fine as high as $2,000.

The indictment comes after what state Attorney General John Formella described as a thorough examination of the evidence. Formella stressed the importance of ensuring that all, including public officials, are treated equally under the law.

In announcing the charges, Attorney General Formella stated, "No person is above the law, and the evidence in this case required investigation and presentation to the grand jury." His remarks underscore the gravity with which the justice system regards its impartiality.

Justice Placed on Administrative Leave

Hantz Marconi has been on administrative leave since July, as the investigation unfolded.

This move allowed the state's justice department to complete their inquiry thoroughly without additional allegations arising during the proceedings. The decision to proceed with charges against a sitting Supreme Court justice was not made lightly, as Formella reiterated.

He said, "The decision to charge a sitting Justice of the New Hampshire Supreme Court was not made lightly, and it comes after careful and thoughtful deliberation." This statement aimed to reassure the public about the integrity of the judicial process.

Hantz Marconi’s legal representation has been vocal in her defense, denying any wrongdoing on her part. Her attorneys have announced their intention to file motions to dismiss the charges, asserting their client's innocence.

The attorneys for Hantz Marconi were assertive in their statements, boldly declaring their client's innocence. "Justice Hantz Marconi is innocent. She did not violate any law or rule. We will fight the charges to the fullest extent permitted by the law," they declared.

Her defense team stressed that "We intend to fight these wrongful accusations in court, where the fight should occur, and not in the media." This emphasizes their commitment to ensuring a legal resolution rather than a public, media-driven narrative.
