Watchdog Sues Biden Administration Over Menthol Cigarette Documents

A lawsuit has been launched by Protect the Public's Trust against the Department of Health and Human Services over undisclosed documents related to menthol cigarette regulations.

Fox News reported that Protect the Public's Trust has initiated legal action against the Department of Health and Human Services for not providing information requested under the Freedom of Information Act. The nonpartisan watchdog group, Protect the Public's Trust (PPT), has filed a federal lawsuit against the Biden administration.

The case centers on unmet Freedom of Information Act (FOIA) requests regarding proposed regulations to ban menthol cigarettes, a move that has sparked considerable debate across various sectors.

In December, PPT submitted four FOIA requests to both the Department of Health and Human Services (HHS) and the Food and Drug Administration (FDA). These requests aimed to obtain documents shedding light on the discussions and rationale behind the proposed nationwide ban on menthol cigarettes.

Overdue Response Triggers Federal Lawsuit

More than three months have elapsed since these requests were filed, yet HHS has neither provided the requested documents nor clarified which documents might be withheld or why. This lack of response has propelled PPT to allege that HHS is neglecting its duties under FOIA.

According to PPT, they have exhausted all administrative remedies available and now seek judicial intervention to compel HHS to release the information. The group claims this step is necessary to ensure transparency and uphold the public's right to understand the factors influencing governmental policies.

The delay in the regulations, still pending finalization, adds to the urgency for clarity and openness from HHS. The proposal to outlaw menthol cigarettes is currently in the final review stages at the Office of Management and Budget (OMB), awaiting a decision.

FDA Cites Public Health Benefits

The FDA has justified the proposed ban by stating that removing menthol cigarettes from the market would be beneficial for public health. They argue that it would deter youth from starting to smoke, aid current smokers in quitting, and ultimately reduce disease and death associated with tobacco use.

However, this regulatory step has not been without controversy. While health advocates largely support the ban, concerns have been raised by civil liberties groups and the business community regarding its potential impacts.

Significant among the concerns is the disproportionate effect such a ban could have on minority communities. Civil rights organizations have voiced fears that the ban could lead to increased interactions between these communities and law enforcement.

Political and Social Dimensions of the Menthol Ban

Recent meetings have brought together key figures such as HHS Secretary Xavier Becerra, FDA Commissioner Robert Califf, and White House domestic policy adviser Neera Tanden with representatives from various minority and civil rights groups. These discussions reflect the complex social and political dimensions that the menthol cigarette ban encompasses.

Michael Chamberlain, head of PPT, commented on the situation, noting the unexpected political challenges. "The Biden administration and FDA probably thought they would be greeted as conquering heroes when they announced the menthol ban. But the science and, as they soon found out, the politics appear to be a lot more complicated than that," he said.

Chamberlain further criticized the lack of transparency from federal agencies, emphasizing the importance of public access to information. "The rule is highly controversial, and it’s important for the American public to understand the factors driving the administration's actions here. But, despite our best efforts and Mr. Biden's claim of running the most transparent administration in history, the agencies won't produce records. That seems to indicate there's something they don't want the public to know," he added.

Final Steps in the Regulatory Process

An FDA spokesperson reiterated the agency's commitment to advancing the tobacco product standards. "The FDA remains committed to issuing the tobacco product standards for menthol in cigarettes and characterizing flavors in cigars as expeditiously as possible; these rules have been submitted to the [Office of Management and Budget] for review, which is the final step in the rulemaking process. As we’ve made clear, these product standards remain at the top of our priorities," the spokesperson told Fox News Digital.
