In December, PPT submitted four FOIA requests to both the Department of Health and Human Services (HHS) and the Food and Drug Administration (FDA). These requests aimed to obtain documents shedding light on the discussions and rationale behind the proposed nationwide ban on menthol cigarettes.
More than three months have elapsed since these requests were filed, yet HHS has neither provided the requested documents nor clarified which documents might be withheld or why. This lack of response has propelled PPT to allege that HHS is neglecting its duties under FOIA.
According to PPT, they have exhausted all administrative remedies available and now seek judicial intervention to compel HHS to release the information. The group claims this step is necessary to ensure transparency and uphold the public's right to understand the factors influencing governmental policies.

But the science and, as they soon found out, the politics appear to be a lot more complicated than that," he said.
Chamberlain further criticized the lack of transparency from federal agencies, emphasizing the importance of public access to information. "The rule is highly controversial, and it’s important for the American public to understand the factors driving the administration's actions here. But, despite our best efforts and Mr. Biden's claim of running the most transparent administration in history, the agencies won't produce records. That seems to indicate there's something they don't want the public to know," he added.
An FDA spokesperson reiterated the agency's commitment to advancing the tobacco product standards. "The FDA remains committed to issuing the tobacco product standards for menthol in cigarettes and characterizing flavors in cigars as expeditiously as possible; these rules have been submitted to the [Office of Management and Budget] for review, which is the final step in the rulemaking process. As we’ve made clear, these product standards remain at the top of our priorities," the spokesperson told Fox News Digital.
