Trump's lawyers ask SCOTUS to overturn Colorado ballot removal ruling

Former President Donald Trump was removed from the Colorado ballot in December, sparking massive backlash across the country. 

According to NBC News, in the wake of the Colorado Republican Party asking the Supreme Court to review the matter, Trump and his lawyers followed suit.

The state court ruling, for now, has kept Trump on the ballot until the Supreme Court rules on the matter.

NBC News noted:

The Colorado Supreme Court based its Dec. 19 ruling on language in the Constitution's 14th Amendment that prohibits those who "engaged in insurrection" from running for various federal offices. The case raises various novel legal questions, including whether the language applies to those running for president and who gets to decide whether someone engaged in insurrection.

Trump's lawyers, in a 43-page filing, asked the high court to overturn the Colorado Supreme Court's ruling.

Jonathan Turley added, "The issue is now the clock. The Colorado Supreme Court mandated that, if the Supreme Court does not act by tomorrow, Trump will be left on the ballot. The question is whether Colorado will seek to moot out the case to avoid review."

Trump's legal team said that if the Colorado high court's ruling stands, it would "mark the first time in the history of the United States that the judiciary has prevented voters from casting ballots for the leading major-party presidential candidate."

Notably, the Colorado Supreme Court's ruling only affected the GOP primary election. NBC News noted that it remains to be seen if the issue will be applied to the general election later this year.

Legal experts and high-profile politicians lean toward the Supreme Court overturning the state's ruling, which would also affect other states attempting the same unprecedented maneuver.

"The Supreme Court should immediately take this case and reverse the ludicrous decision by the Colorado court. The left’s rabid desire to prevent voters from electing the president of their choice is insane," Sen. Josh Hawley wrote

Sen. Ted Cruz (R-TX) added, "I believe the Supreme Court will hear the Colorado case—and there is a chance they will rule unanimously against the state. The effort to keep President Trump off of the ballot is utterly lawless."

Maine's Democratic secretary of state announced a similar ruling last week. The non-lawyer secretary received major backlash as a result, and Trump's lawyers have already taken the issue to the state's top court.

Only time will tell if the U.S. Supreme Court quashes this nonsense once and for all.
