Trump lawyer believes Justice Kavanaugh will 'step up' during ballot ban case

Donald Trump's attorney, Alina Habba, made a bold prediction, singling out Supreme Court Justice Brett Kavanaugh, stating that she expects him to rule in favor of Trump in the ongoing legal battle over his eligibility for the 2024 ballot.

This prediction comes in the wake of Trump's legal team seeking Supreme Court intervention to overturn decisions by both Colorado and Maine authorities, which barred him from the ballot based on allegations of engaging in "insurrection" following the 2020 election.

The case

The Colorado Supreme Court ruled last month that Trump's involvement in the events leading to the Capitol riot on January 6 constituted "insurrection," invoking Section 3 of the 14th Amendment.

This section prohibits individuals engaged in "insurrection or rebellion" from holding federal office.

Trump's lawyers argue that he has neither been charged nor convicted of insurrection and should not be disqualified from the ballot.

The interview

Speaking on Fox News' Hannity, Habba discussed the cases, emphasizing that the Supreme Court's decision could bring clarity and address confusion among states. She challenged the actions of authorities like Maine's secretary of state, who, in her view, applied obscure statutes to a former president without legal merit.

Habba underscored her faith in the Supreme Court, particularly highlighting Kavanaugh, whom Trump fought to appoint, suggesting that justices would base their decisions on a commitment to the law and fairness.

She clarified that their stance is not merely pro-Trump but rooted in a dedication to upholding the law, emphasizing the clear legal context of the matter.

The battle

The legal challenge revolves around the interpretation of the 14th Amendment and its application to Trump's eligibility for the 2024 ballot.

Habba reiterated that Trump's concerns about potential biases against him are valid, emphasizing the conservative inclination to avoid being labeled as overly "pro-Trump."

She urged a careful examination of the law and Constitution, emphasizing that the decision should be devoid of political considerations and should reflect a commitment to American principles.

The attorney also responded to comments from New York Times reporter Maggie Haberman, who suggested that Trump anticipates prevailing in legal matters but is apprehensive about the optics of rulings that might appear unfavorable.
