Trump Gets Third Deadline Extension For Expert Witnesses In Classified Documents Case

In the ongoing case involving former President Donald Trump and his co-defendants, a federal judge has granted an additional extension for revealing expert witnesses.

Law And Crime reported that Judge Aileen Cannon ruled in favor of the extension despite opposition from the special counsel. Judge Cannon, presiding over the U.S. District Court, set a new deadline of July 8 for the defendants to submit their expert witness notices.

This decision came after a request was made by Trump, his valet Walt Nauta, and Mar-a-Lago property manager Carlos De Oliveira on the day the notice was originally due.

The defense team pointed to several factors justifying their need for additional time. They cited the conclusion of a demanding six-week trial in New York, which resulted in Trump facing 34 felony convictions. These challenges were coupled with ongoing preparations based on recent disclosures from the Special Counsel’s Office.

Defense Team Faces Unique Challenges

In their plea for an extension, Trump's lawyers emphasized the extraordinary circumstances they faced. They detailed the intensive process of reviewing recent classified and unclassified discoveries, which were critical to their case. They also faced last-minute complications with engaging a pivotal expert witness.

According to Trump’s lawyers, they had been "diligently working to identify and engage potential expert witnesses." However, an expected expert witness withdrew their availability over the weekend leading up to the notice deadline, further complicating their situation.

The defense argued that the timing of the New York trial had significantly impacted their ability to meet the deadlines set by the court. They highlighted the continuous stream of preparatory work necessary to address the ongoing discoveries from the Special Counsel’s Office.

Despite the defense team's arguments, the Special Counsel's Office, led by Jack Smith, opposed the extension. Smith’s team had consistently objected to each of the previous two extensions granted in this case.

In their argument, the Special Counsel's Office pointed out that this third request was only made on the day the deadline was originally set. They argued that such repeated delays hindered the trial process and that significant extensions had already been granted despite their objections.

Smith’s team also noted that the defense had ample time since November 2023 to prepare their expert witness notices. They suggested that any additional extension would further delay the proceedings unnecessarily.

Judge Cannon’s Decision And Directives

Judge Cannon ultimately sided with Trump's defense team, agreeing there were "good cause" reasons for the extension. She asserted that granting the extension would not prejudice the Special Counsel or the proceedings.

However, Judge Cannon issued a stern warning regarding future requests for deadline extensions. She instructed that any future extension requests "must be filed sufficiently in advance of the deadline at issue."

Trump’s defense team assured the court that they had not been idle in their efforts. They were actively reviewing all the discovery materials provided by the Special Counsel and were preparing a pretrial motion based on certain disclosures.

The Mar-a-Lago case revolves around alleged mishandling of classified documents by Trump and his associates. The case's complexity has resulted in numerous procedural developments, with this third extension being one of the latest.

The context of the June 10 deadline and the last-minute nature of the extension request have added layers to the ongoing legal battle. The back-and-forth between the defense team and the Special Counsel underscores the ongoing tension in this high-stakes case.

The presence of multiple co-defendants adds another layer of complexity. Valet Walt Nauta and property manager Carlos De Oliveira are caught up in the same legal proceedings, further intertwining their fate with Trump’s in this case.

Conclusion

The recent decision by Judge Cannon to extend the deadline for expert witness notices demonstrates the court's acknowledgment of the defense team's challenges. However, it also highlights the ongoing friction between Trump's legal team and the Special Counsel.

This extension marks the third such instance, with each request prompting objections from the Special Counsel. Judge Cannon’s decision stipulates that future requests for extensions be made well in advance, aiming to streamline the process going forward.

As the case unfolds, the new deadline of July 8 for submitting expert witness notices will be a critical date to watch. The defendants' ability to meet this deadline will likely impact the trial's trajectory and the overarching legal battles surrounding former President Trump.
