As we all know, President Donald Trump has been getting hammered in the courts over his executive orders.
Well, Wednesday and Thursday were not very good days for the 47th president, as multiple judges struck down certain of his actions.
Trump was hit twice on orders aiming to block expenditures over policy issues, which he does not have the authority to do, as I have discussed multiple times.
When money is approved by Congress and signed into law, the only way to stop the flow of money is for Congress to step in and legislate it.
U.S. District Judge William H. Orrick ruled that Trump blocking money to sanctuary cities is unconstitutional. And yes, he was appointed by a Democrat, but that has nothing to do with this order, as this issue is well-settled in precedent.
U.S. District Judge Landya McCafferty, another Democrat-appointed judge, partially blocked Trump’s funding freeze regarding DEI policies. She called Trump’s order “textbook viewpoint discrimination.”
Trump was also dealt a defeat in his election integrity order. Judge Colleen Kollar-Kotelly is wrongly being reported as a Bill Clinton appointee, but Kollar-Kotelly was initially appointed to her first judicial role by Ronald Reagan, then later elevated to the federal court by Clinton.
Two provisions of the order were blocked. The first was the requirement that individuals provide proof of citizenship to be able to vote. The second was that federal agencies offer voter registration only after assessing an individual's citizenship status.
Several other provisions of the order were challenged, but the judge stated that they are better addressed at the state level, so she did not address them.
If you ask me, this should not be a partisan issue, as I don’t understand the resistance at all levels to ensure that everyone voting is a citizen. If they are offering voter registration as state agencies, why would they not access citizenship information before offering the service? That would just make sense, right?
Finally, we have Trump-appointed U.S. District Judge Stephanie Gallagher, who ordered a second migrant that was deported by the administration to be returned.
The migrant, only referred to as “Christian” in the suit, was part of the group that Trump had deported to El Salvador last month, but Judge Gallagher says it never should have happened.
Gallagher ordered that the Trump administration needed to be "making a good faith request to the government of El Salvador and to release Cristian to U.S. custody for transport back to the United States to await the adjudication of his asylum application on the merits by USCIS."
You guys have heard me go off before about Trump’s orders, and it is not because I don’t support the agenda, because I do. However, the way these orders were crafted, they are clearly illegal and unconstitutional, most circumventing current laws or Congress, which Trump, even as president, does not have the power to do. As a result, taxpayers are being hit with millions in legal fees to argue cases we have no chance of winning.
