Trump blasts Supreme Court for cowardly ruling on deporting violent gang members

The Supreme Court has ruled in a 7-2 decision that Venezuelan Tren de Aragua gang members must receive adequate notice before deportation, leading to criticism from former President Donald Trump.

Breitbart reported that the ruling obliges the Trump administration to offer sufficient advance notice to suspected gang members before deporting them under the 1798 Alien Enemies Act, sparking concerns about the ramifications for immigration policy.

The Supreme Court's decision focused on the treatment of detainees that the Trump administration sought to deport under the Alien Enemies Act (AEA), which has been part of American law since the late 18th century.

In its ruling, the Court highlighted that individuals facing deportation had not been given enough warning, specifically pointing out that mere overall notice 24 hours before deportation did not meet the necessary standards.

Emphasis on Proper Legal Procedures

According to the Court, the lack of detailed information regarding due process rights and how to contest removal was problematic. The justices maintained that sufficient notice must be granted to these individuals so they have the opportunity to understand and exercise their legal rights.

The ruling also temporarily blocked deportations to assess how best to notify detainees, with the justices remarking that other legal avenues remained open for the government to pursue these removals.

President Trump originally invoked the AEA in an attempt to speed up the expulsion of suspected TdA gang members from Venezuela. However, his approach has faced significant legal challenges. The Supreme Court stopped short of commenting on the legality of the deportations themselves but concentrated on the procedures being used.

Trump did not hold back his displeasure, voicing strong opposition to the ruling. He articulated concerns that such judicial requirements might hinder his administration's ability to quickly deport individuals he characterized as “the worst murderers, drug dealers, and gang members.”

He insisted that the new legal hurdles could extend the deportation process substantially, enabling these individuals to commit further criminal activities within the U.S.

The former president expressed frustration over what he perceives as an inconsistency in immigration practices. He criticized the current administration, suggesting that it has allowed a substantial number of undocumented immigrants into the country without adequate legal procedures while placing excessive burdens on removing them.

Public Concerns Amid Legal Challenges

In his statements, Trump’s frustration was evident as he accused the Supreme Court of obstructing his policy objectives.

He warned that the decision might have detrimental outcomes, potentially encouraging other criminals to enter the country illegally. The former president warned of “great harm” to Americans, highlighting public safety as a central issue.

The majority opinion from the justices clarified their position on the necessity of providing adequate notice. They emphasized that the detainees deserved more than what had been provided, underscoring a need for judicial oversight while standards for appropriate notice are clarified.

Critics of Trump's approach argue that this ruling underscores the importance of due process, even in immigration cases involving suspected criminal activities. They contend that ensuring proper legal procedures aligns with fundamental legal principles and human rights standards.

Supporters of the former president, however, echo his sentiment, stressing the need for quicker legal processes to remove individuals who pose potential threats to national security or public safety. They see the Supreme Court decision as an impediment to protecting American citizens.
