Lawyers representing Jose Ibarra, a suspect in a high-profile murder case, are working to suppress key evidence in the trial for the killing of a Georgia college student.

On February 22, 2024, Laken Riley, a 22-year-old nursing student from Augusta University, was tragically killed while running on the University of Georgia campus. The next day, Jose Ibarra was detained, leading to a series of legal battles centered around the evidence gathered by the authorities.
Ibarra’s legal team contends that the evidence, which includes two cellphones, a buccal swab for DNA testing, and location data from Google, was collected illegally. They argue that the authorities did not have a sufficient basis for Ibarra’s detention and subsequent evidence collection.
Further complicating the case, Ibarra's defense is challenging the DNA analysis conducted using TrueAllele Casework Software, which they claim produced ambiguous results.
The contested items were seized during a search the day after Riley’s death, which Ibarra's attorneys claim was conducted without proper legal justification. This has prompted a request for a hearing to examine the legality of the evidence collection.
According to court documents, the DNA analysis provided by forensic biologist Ashley Hinkle did not conclusively determine the presence of Ibarra’s DNA at the crime scene. The results, instead, offered various probabilities which did not definitively link him to the murder.
"Due to the complexity of the mixture used in testing, the testing was analyzed by using TrueAllele Casework Software.
The results of this analysis were reported by Ashley Hinkle on April 3, 2024. Those results gave various probabilities of whether or not the sample in question was more or less likely to be a particular individual or a coincidental match," stated the court documents.
The defense argues that the inconclusive DNA analysis should lead to the exclusion of the DNA evidence altogether. This motion is a crucial part of their strategy to challenge the prosecution's narrative.
Aside from the DNA and physical evidence, Ibarra’s case is further complicated by his and his brother’s legal status in the United States. Both were residing illegally near the crime scene after entering the U.S. from Venezuela through El Paso, Texas, in September 2022.
His brother, Diego Ibarra, faces charges of green card fraud and alleged connections to a Venezuelan gang, adding layers of complexity to the defense’s portrayal of Jose Ibarra’s background and their family's situation.
Jose Ibarra was formally indicted by a Georgia grand jury in May 2024, facing charges of malice murder and aggravated assault. The indictment followed allegations that he caused Riley’s death by blunt-force trauma and asphyxiation.
On the day of the alleged murder, Ibarra is also accused of engaging in suspicious activity, including spying on a university staff member, which has been leveraged by the prosecution to depict a pattern of concerning behavior.
