The contest, which commenced on October 19, was initiated by Elon Musk’s America PAC, targeting registered voters in seven pivotal swing states.
America PAC's director, Chris Young, stated that the selection of winners was based on their ability to act as spokespeople, challenging the notion of random selection.
Philadelphia's chief prosecutor filed a lawsuit on October 28 to halt the campaign, arguing that it violated state lottery laws. However, the court’s decision allowed the continuation of Musk's initiative, citing a lack of random selection in the winner's process.
Elon Musk, a staunch Donald Trump supporter who has donated substantially to his campaign, framed the giveaway as a means to promote free speech and gun rights. At an October 19 Trump rally, Musk declared, "All we ask is that the winners serve as America PAC spokespeople."
The judge's brief written order denied the motion to halt the giveaway, with a promise of detailed reasoning to follow. This interim order has sparked varied reactions among legal experts, with some questioning the implications for election laws.
Musk's legal representative, Andy Taylor, defended the giveaway, emphasizing its role in supporting constitutional rights.
"They're trying to restrain citizens of Pennsylvania from signing a free speech and right to bear arms petition," Taylor argued in court.
Conversely, John Summers, representing Philadelphia's prosecutor, expressed skepticism about the defense's narrative. "If their story is true, it's one of the greatest scams of the last 50 years," Summers commented, highlighting the depth of controversy surrounding the giveaway.
