Nevada Supreme Court Declines To Dismiss Appeal on 'Fake Electors' Case

The Nevada Supreme Court has chosen to hear an appeal related to six Republicans accused of misrepresenting the results of the 2020 presidential election in the state.

8 News Now reported that this legal decision follows unsuccessful attempts to dismiss the case, which now involves similar accusations presented in Carson City District Court by the Nevada Attorney General’s Office.

In December 2020, a significant event unfolded as six Republican individuals alleged that Donald Trump had prevailed in the Nevada presidential election, despite official results to the contrary.

Trump, in fact, lost Nevada by a margin of over 33,000 votes, equivalent to 2% of the total votes in the state. Despite knowing the official outcome, these individuals performed a symbolic ceremony where they claimed to cast electoral votes for Trump.

The False Certificates and Legal Repercussions

After the ceremony, the group sent fabricated electoral certificates to Washington, D.C., in a bid to support their false claims.

However, their actions had no legal standing. The lawful state electoral ceremony was conducted by then-Secretary of State Barbara Cegavske, a member of the Republican Party, who upheld the true results of the election.

Years later, in 2023, a grand jury in Clark County indicted the six individuals. They face charges for filing a false instrument and uttering a forged instrument, serious felonies carrying potential penalties of four to five years in prison.

The case initially faced a roadblock when Judge Mary Kay Holthus dismissed it due to issues with the venue. However, the state decided to contest this dismissal, elevating the matter to the Nevada Supreme Court.

The highest state court has the responsibility to examine the appeal arising from the district court's decision to dismiss the criminal proceedings.

The Nevada Supreme Court's decision to continue with the appeal emphasizes the gravity of the allegations and the importance of adjudicating them. As of the latest update, there has been no schedule set for oral arguments in this case.

Subsequent to the Supreme Court's involvement, parallel charges have been initiated by the Attorney General’s Office in the Carson City District Court. This move reflects the determination to ensure that legal consequences are pursued, despite initial setbacks in Clark County.

In the subsequent presidential election of November 2024, Donald Trump emerged victorious, defeating Vice President Kamala Harris by a margin exceeding 46,000 votes.

Role of State Republican Electors

Among those charged, Michael McDonald and Jesse Law participated as Republican Party electors.
