Man Receives Near-Maximum Sentence For Capitol Riot Involvement

David Nicholas Dempsey's 20-year sentence for his violent actions in the U.S. Capitol riot marks one of the severest punishments related to the event.

Fox News reported that Dempsey, involved in assaulting police officers during the January 6, 2021, riot, has been handed a significant 20-year prison term. His actions during the tumultuous events have led to severe legal consequences.

In January following his guilty plea, he was convicted on two counts of assaulting police with dangerous weapons.

The range of improvised weapons Dempsey used includes a metal crutch, poles, pepper spray, and broken pieces of furniture. These items were employed in a concerted effort to breach police defenses during the riot. Moreover, Dempsey orchestrated the use of human scaffolding, a tactic involving other rioters to overcome the officers guarding a pivotal tunnel entrance.

In an exhibit of his aggressive behavior, Dempsey not only targeted police but also a fellow rioter trying to stop him. This incident demonstrated his deliberate intent to cause harm and disrupt the lawful processes underway at the Capitol.

Dempsey’s attorney, Amy Collins, contended that the lengthy sentence reduces Dempsey to merely a statistic and fails to account for his personal development post-event. She described the sentence as overlooking "the person he is, how much he has grown."

The Consideration of Prior Custody

Dempsey has been in custody since August 2021, a factor that was considered in the 20-year sentence handed down.

The time already spent in prison will be applied towards his sentence, slightly reducing the duration of his future incarceration.

With this sentencing, Dempsey receives one of the longest sentences among those involved in the January 6 events, second only to Enrique Tarrio, leader of the Proud Boys, who received a 22-year sentence.
