Local school district's transgender notification, critical race theory ban upheld by California judge

A judge in California has supported a regulation that requires the Temecula Unified School District to inform parents if their child decides to alter their gender at school and a prohibition on Critical Race Theory classes in the district.

Despite facing significant pressure from activist groups, Governor Gavin Newsom, and the media, conservative parents and school board members were able to enact these measures, and this verdict represents a victory—albeit a temporary one, as Breitbart News reported.

According to critical race theory, racism permeates every aspect of American society.

Background of the policy

According to an August Breitbart News article, legal advocates challenged the constitutionality of the Critical Race Theory ban that had been imposed by the Temecula school system in 2022.

The Los Angeles Times reports that last Monday, Judge Eric Keen of the Riverside County Superior Court denied the activists' plea for a temporary injunction against the district's policy, although he ultimately upheld them.

On Friday, however, Judge Eric Keen dismissed the case, citing the lack of clarity in the district's policy as the reason.

The board's decision lays out the particular aspects of critical race theory that cannot be taught, he noted in an eight-page ruling.

From the Ruling

Critical race theory, according to Keen, will have a "subordinate role within a larger instructional framework" that addresses the "flaws" of the curriculum, and the resolution prevents that from happening.

Additionally, Keen shared his thoughts on a contentious policy that mandates district employees to inform parents if their child requests to be identified by a name other than their legal name or a different gender.

His statement asserted that this policy applies to any student who wants to change their school official or unofficial records. He went on to say that the policy is "gender neutral" and doesn't expressly single out transgender or gender-nonconforming students.

Questions for Newsom

When asked by Breitbart News in the spin room at the Ronald Reagan Presidential Library following the Republican presidential primary debate in September, Newsom could not explain why parents should not be informed about their children's gender transitions, despite the fact that he has singled out the district for criticism.

A distinct debate over the district's rejection of a state-approved curriculum that includes LGBTQ historical figures—including San Francisco Supervisor Harvey Milk, whom one board member referred to as a "pedophile"—remains unaffected by the judgment. The district was penalized $1.5 million by Gov. Newsom for removing Milk from the curriculum.

Over the transgender notice policy, multiple other school board districts have also gone against Newsom's wishes, leading to potential legal disputes. In a recent survey, 84% of California voters supported the idea that parents should be informed, suggesting that the liberal state's voters are opposed to Newsom.
