Judge in Hunter Biden federal tax case unconvinced by defense attorney's claims the prosecution is politically motivated

Attorneys for Hunter Biden attempted to get federal tax charges thrown out on the basis that they were only brought because of politics, National Review reported. However, the judge in the case wasn't convinced.

Biden is facing several criminal charges, including nine tax charges, six misdemeanors, and three felonies.  The tax charges stem from his failure to pay his taxes between 2016 and 2019.

He is accused of filing false tax returns during that period and reportedly owes $1 million. In addition, Biden has federal gun charges pending relating to a handgun purchase he made while concealing his drug addiction.

After skirting punishment for so long, special counsel David Weiss is finally prosecuting Biden for these crimes. However, his attorney, Abbe D. Lowell, attempted to argue it was nothing more than playing politics.

Defense Strategy

Lowell petitioned District Judge Mark Scarsi to throw out Biden's case in a hearing Wednesday, arguing the political angle. "There is nothing regular about how this case was initiated [and] investigated," Lowell claimed.

Scarsi wasn't convinced that it was a politically motivated investigation or prosecution based on the protestations of the defense attorney. He then questioned Lowell whether she had any proof of such motives, according to Breitbart.

"I don’t have transparency," Lowell shot back.  "What I have is the type of evidence that [a prosecutor] goes to a jury with every week and says 'you can connect the dots,'" she offered as proof.

Later, Scaarsi pointedly asked the attorney whether there was any "evidence that pressure from outside entity influenced the prosecution" or the Department of Justice. All Lowell could come up with was the timing of the case.

“It’s a timeline, but it’s a juicy timeline,” Lowell responded. Weiss was asked to testify to Congress while the GOP began an impeachment inquiry into Hunter Biden's father, President Joe Biden.

Tip of the Iceberg

While Biden's defense claims political prosecution, the GOP believes the younger Biden is being shielded by his powerful father. "We believe there’s significantly more tax liability than what he has," House Oversight Committee Chair James Comer (R-KY) said.

"We also know that there’s money laundering. We get that from all the suspicious activity reports. Most of the 170 suspicious activity reports at Treasury implied that the Bidens were money laundering and, from what we can look at with their bank statements now and the research we’ve done, I can confirm it sure looks like money laundering to me," Comer said.

"You also have the obvious violation of the Foreign Agents Registration Act, and who was he lobbying for? He was lobbying for China, Russia, and some of the worst countries in the world," Comer charged.

"But also, he was lobbying his father, so that makes Joe Biden liable in Foreign Agent Registration Act liability. So we’ve got a lot of concerns here. This is the tip of the iceberg," Comer said.

Neither the Republicans nor the judge believe that Hunter Biden is a victim of a political stunt. If anything, it's likely that the problem goes much deeper and has gone on much longer because of who he is related to.
