Judge finds Biden administration improperly cancelled Alaska oil and gas drilling leases

A federal judge in Alaska has determined that the U.S. Department of the Interior acted improperly when it terminated seven oil and gas leases in the Arctic National Wildlife Refuge without a court's approval.

The Epoch Times reported that this decision marks a significant victory for the Alaska Industrial Development and Export Authority, which had contested the lease cancellations implemented under the Biden administration's directives.

The case arose from a decision initially made during the final days of President Donald Trump’s term, where these leases were granted.

Following his inauguration, President Joe Biden signed an executive order on January 20, 2021, directing a suspension and review of these leases, citing potential legal issues.

Judge Gleason's Detailed Analysis

The ruling, handed down on Tuesday by U.S. District Judge Sharon Gleason, involved a detailed 22-page order explaining her reasoning.

Judge Gleason argued that the Department of the Interior should have sought judicial intervention before canceling the leases, which were originally allotted to AIDEA in 2021.

In her assessment, Judge Gleason noted a similarity with existing federal acts like the Naval Petroleum Reserves Production Act, which mandates a court order for such lease cancellations. Hence, her ruling found the Department's actions not compliant with the law.

AIDEA had initiated legal proceedings against the lease cancellation as early as November 2021. However, their initial suit faced dismissal. Persistence bore fruit when they filed a subsequent lawsuit in 2023, this time finding favor with the court.

The court's ruling drew attention to a provision in the 2017 Tax Cuts and Jobs Act concerning leasing in Alaska's invaluable habitats. Judge Gleason underscored that the provision reinforced the necessity of a judicial order as a procedural prerequisite in such actions.

Responses from local authorities were notably supportive of the ruling. Alaska Governor Mike Dunleavy lauded the decision, expressing hope that the leasing program would proceed, ultimately boosting economic and energy production in the state.

Governor Dunleavy communicated optimism, believing that this decision would pave the way for more robust energy security derived directly from Alaska’s efforts. In tandem, AIDEA viewed the court’s decision as a triumph, emphasizing adherence to Congressional guidelines.

Statements from AIDEA on the Ruling

Randy Ruaro, AIDEA's Executive Director, celebrated the court’s decision, emphasizing the importance of the ruling as a check against politically motivated actions by federal agencies. He remarked that the judgment confirms that lawful processes should be followed irrespective of political agendas.

Ruaro articulated his viewpoint by suggesting that Alaska's development opportunities should not be unnecessarily thwarted by federal administrations’ initiatives. The ruling, according to Ruaro, affirms the rule of law and reinforces the boundaries within which governmental entities must operate.

In light of the ruling, Interior Secretary Doug Burgum has directed the Bureau of Land Management to explore further opportunities within the region. This initiative aligns with advancing energy resource activities in the National Petroleum Reserve and Arctic National Wildlife Refuge.

The measures are intended to bolster both exploration and development, indicating a potential shift in energy policy priorities in respect of Alaska's resource-rich landscape. This decision may kindle more extensive discussion and policy recalibration regarding federal agency powers and the need for judicial oversight.
