Harris County Judge Recalls All Outstanding Warrants, Unprecedented Action Draws Outrage

In an unprecedented move, Judge Steven Duble of Harris County Justice of the Peace Precinct 1 has recalled all outstanding warrants from his court, sparking debate and raising legal concerns. Judge Duble’s decision impacts a variety of cases, including traffic citations, evictions, and Class C misdemeanors.

FOX 26 reported that the recall announced through a letter dated August 22 has generated significant backlash from legal experts and local officials, some of whom question both the legality and the potential public safety implications of such a broad action.

Judge Duble, who assumed his role as Justice of the Peace for Precinct 1 in 2023, issued the blanket recall with little public explanation. The warrants being recalled include those for Class C misdemeanors, bad checks, traffic violations, and eviction orders.

One of the loudest voices questioning the decision is Chris Tritico, FOX 26 Senior Legal Analyst, who expressed his disbelief. “I've never seen this happen in the 37 years I've been doing this,” he said.

Tritico explained that the scope of this recall, without clarification, sets a confusing precedent for the legal system and affects numerous individuals who may now find themselves without accountability for their actions.

State Senator Paul Bettencourt also voiced his concerns, calling the decision “nuts” and further emphasizing that it is “exactly what shouldn’t happen by a judge in the 21st Century.” Both Bettencourt and Tritico emphasized that such a decision could lead to broader issues within the justice system, particularly around accountability and legal clarity.

The Harris County District Attorney's Office was similarly alarmed, stating that the decision could compromise public safety.

In a statement provided to FOX 26, the District Attorney’s Office said, "We only recently were made aware of Judge Duble’s inexplicable decision to grant fugitives a free pass in his courtroom." The office went on to warn that the decision could endanger both law enforcement officers and the general public by releasing individuals who might otherwise be held accountable through the warrant system.

Tritico echoed these concerns, pointing out that those who had pending cases in Judge Duble’s court may now be let go without consequence. "They may all have cases pending in there that have now been let go," he stated, highlighting the wide-reaching effects of such a decision.

Lack of Precedent Leaves Legal Gray Areas

Senator Bettencourt pointed out that the legal system may not be fully prepared to handle the repercussions of Judge Duble's decision. “The law may not be as clear, because no one's been quite frankly crazy enough to do this until now,” Bettencourt said, underscoring the novelty of the situation.

While Judge Duble has maintained that his decision followed careful research, critics are demanding further explanation and accountability. The absence of clear legal authority for such a move has left many wondering whether it can stand without challenge.

The Harris County District Attorney’s Office stressed that "accountability is fundamental to justice" and expressed concerns that this decision could lead to a loss of faith in the judicial process.

Judge Duble’s statement, which was prepared in response to the public outcry and sent just minutes after a 9 p.m. newscast, did little to calm these concerns.
