Former Justice Anthony Kennedy has a new book coming out, so he is starting to do the media circuit.
I would consider Kennedy in the mold of Justice Roberts, meaning he is more moderate than far right.
The current state of the court bothers him, stating that he believes opinions are starting to get way too personal and vindictive, and I could not agree more.
In my opinion, Justice Sonia Sotomayor is an activist who should be removed from the bench.
I know it will never happen, but I believe she is very much to blame for the animosity conservative justices are facing these days, along the Biden’s appointment, which I will get to in a moment.
The tipping point for me on Sotomayor was when she suggested that Trump could order SEAL Team 6 to take out a political opponent, and it would be immune from prosecution. Her dissent was completely ridiculous, with very little fact in it.
More recently, she slammed the administration’s efforts to enforce our immigration laws, stating, "We should not have to live in a country where the Government can seize anyone who looks Latino, speaks Spanish, and appears to work a low wage job. Rather than stand idly by while our constitutional freedoms are lost, I dissent." Again, very few facts make it clear that she is an activist, not a jurist.
Jackson had made it a point to put her personal feelings into her dissents, which again is utterly ridiculous.
Personal feelings are not supposed to be included in rulings, as these rulings are based on the law and that particular justice’s interpretation of the law.
On her highly controversial opinions, Jackson explained, "I just feel that I have a wonderful opportunity to tell people in my opinions how I feel about the issues, and that's what I try to do.”
Nobody cares how you feel, and I would say that about any justice, liberal or conservative. Give us your opinion, and how you interpreted the law behind that decision; that is all that is needed or wanted. When you start to talk about your personal feelings in rulings, you have become an activist, and you no longer deserve to wear that robe.
Kennedy has been watching this all play out, and he agrees that things have gotten a bit out of hand.
While promoting his new book, he stated, “I’m actually somewhat concerned about the Court.
“It’s a little bit too personal and confrontational, some of the opinions. I’m hoping that will settle down a little bit.”
The judiciary in this country is headed down a nasty rabbit hole, and I am not sure it will ever find its way back, to be honest. I don’t know how we get judges, especially on the left, who genuinely despise all things conservative, to not judge cases before they hear a shred of evidence. I honestly don’t know if the judiciary, including the Supreme Court, will ever recover.
