FCC rushing review Of Trump’s FOIA request on CBS-Kamala Harris interview

The Federal Communications Commission (FCC) has taken a significant step in expediting a Freedom of Information Act (FOIA) request related to a lawsuit that former President Donald Trump has filed against CBS News.

The Washington Free Beacon reported that the FOIA request concerns internal communications that Trump claims will support his lawsuit, which alleges CBS News tampered with an interview of Vice President Kamala Harris to influence the election.

The FOIA request was submitted by Trump's attorney, Edward Paltzik, on February 7. It seeks to obtain communications among former FCC chair Jessica Rosenworcel, Democratic commissioners, CBS News executives, and the Harris campaign.

The aim is to uncover any potential discussions regarding an interview with Kamala Harris that was aired on CBS's 60 Minutes program on October 7, before the election.

The Call For Investigation Into CBS

On October 31, Trump initiated a lawsuit against CBS News. He claims that the network manipulated the broadcast to sway public opinion and impact the election outcome.

This legal action came after the Center for American Rights filed a complaint on October 16, requesting an FCC investigation into whether CBS News violated regulations by allegedly distorting broadcast news.

In response to the Center for American Rights' complaint, former FCC chair Rosenworcel dismissed the filing on January 16. She stated that the complaint was an attempt to misuse the licensing authority of the FCC. Rosenworcel's decision indicated her belief that the regulatory power of the FCC should not be "weaponized" for such purposes.

Following Rosenworcel's departure, Trump-appointed FCC commissioner Brendan Carr reinstated the complaint. Carr's decision breathed new life into the controversy as it spurred further examinations into the conduct of CBS News.

The FCC's median processing time for expedited FOIA requests in 2022 stood at 11 days. Trump's push for an expedited review reflects the urgency he places on unveiling potential evidence to support his legal assertions against CBS News.

Carr's involvement has not stopped at the CBS case—he has also initiated additional investigations into NPR, PBS, Comcast, and NBCUniversal. These probes are centered around various alleged violations, potentially broadening the scope of FCC scrutiny over media corporations.

Adding to Trump's recent string of legal pursuits, he has secured a $10 million settlement with ABC News, which may influence how media companies respond to his allegations.

Reports suggest that Paramount is contemplating a settlement with Trump related to the Harris interview lawsuit, wherein Trump is seeking $10 billion in damages.
