Democrats in Hawaii attempting to kick Trump off the ballot

Hawaii State Senator Karl Rhoads (D) has introduced a bill that is attempting to remove former President Donald Trump from the ballot.

Rhoads's bill doesn't mention Trump but it does "specify that election ballots issued by the chief election officer or county clerk shall exclude any candidate who is disqualified under Section 3 of the 14th Amendment to the Constitution of the United States; article XVI, section 3 of the Constitution of the State of Hawaii; or another constitutional or statutory provision."

The legal arguments being used in this bill are lifted off those used by Democrats in Maine and Colorado, arguments that have so far failed.

The bill further states, "The legislature finds that citizens of this State have the right to expect that public servants be people of integrity, and not people who have committed actions that threaten democracy or undermine the vote of the people."

The statement "undermine the vote of the people," is a bizarre inclusion considering it is the Democrat Party that is trying to deny the American people the choice of voting for Trump or not.

Lost cause

The efforts to remove Trump from the ballot have failed miserably but Democrats refuse to learn their lesson.

That is ignoring the fact that Trump has never been criminally convicted of insurrection and was actually already acquitted by the United States Senate following the January 6th protest.

Insurrection is the key crime here as the 14th Amendment argument against Trump stems from the phrase that no one that has"engaged in insurrection or rebellion against" the United States should hold public office.

Without a criminal conviction of insurrection, the Democrat Party has no case against removing Trump from the ballot in 2024.

Lawsuits arguing the 14th Amendment against Trump have been struck down in Minnesota, Michigan, Arizona, and Oregon.

Even if Rhoads's bill becomes law, it will immediately be legally challenged and the judiciary has already made it clear how they see this issue. Trump's lawyers will notch yet another legal victory and get more momentum should Hawaii go ahead with this bill.

Denying democracy

The efforts of Democrats to remove Trump from the ballot are denying the right of the people to choose who will be the next president.

The irony of Rhoads as a lawmaker arguing that Americans have a right to public servants that don't "undermine the vote of the people," is particularly rich.

Thankfully, these efforts have failed so far and an impending Supreme Court decision will likely settle the issue for good soon. Democrats will have to beat Trump fair and square in 2024, something they know they can't do.
