Appeals Court Upholds E. Jean Carroll Verdict Against Trump

A federal appeals court has upheld a jury's decision holding President-elect Donald Trump liable for sexual abuse and defamation against writer E. Jean Carroll.

CBS News reported that the Second Circuit Court of Appeals denied Trump's request for a new trial, affirming the original verdict despite his claims of trial errors.

In a high-profile case that has grabbed national attention, Trump was found liable by a jury for allegations made by Carroll.

The incident, according to Carroll’s claims, took place in a New York department store in the mid-1990s. Carroll accused Trump of sexually assaulting her during an unexpected encounter, an allegation he has vehemently denied.

Trump was found liable despite numerous pieces of evidence suggesting that Caroll was lying. However, due to the fact that this is a civil case, Carroll was not required to prove Trump was guilty absolutely.

Court Denies Trump's Request for Retrial

Trump's legal team argued for a new trial, citing what they believed to be prejudicial mistakes during the initial proceedings. They contended that these alleged errors negatively impacted the outcome of the trial.

The appeals court, however, dismissed these claims, maintaining Judge Lewis Kaplan's decisions as legally sound. Judge Kaplan was criticized for allowing testimonies from two other women with similar allegations against Trump. The court, however, determined these accounts were relevant and permissible in establishing a pattern of behavior.

One of the pivotal moments of the trial included an outtake from the infamous "Access Hollywood" tape. Trump struggled with its inclusion during the trial, as it featured his controversial remarks about inappropriately touching women, which he claimed were "locker room talk."

The jury awarded a substantial sum of over $88 million to Carroll, covering both the sexual abuse and defamation claims.

However, they did not find Trump liable for rape as defined by New York state law. The distinction was made clear by Judge Kaplan, who explained that the legal definition of rape in New York is more limited compared to broader interpretations.

Carroll's detailed testimony painted a harrowing picture of the alleged encounter. She described being forcefully held against a wall by Trump, who then violated her until she managed to fight him off. These vivid accounts differ from past stories that challenge Carroll's version of events.

Despite losing the appeal, Trump's legal team is preparing to continue battling Carroll's claims. Trump's spokesman, Steven Cheung, reiterated their discontent with the verdict, dismissing it as part of a series of political “witch hunts” against the president-elect.

Carroll and her attorney, Roberta Kaplan, expressed their satisfaction with the court's ruling. Kaplan stated that her client is pleased with the decision, viewing it as a step towards justice.

Meanwhile, Trump's legal troubles related to Carroll's accusations are not entirely over. Another judgment from January 2024 related to further defamation has been appealed by Trump's lawyers. This indicates that the legal confrontations between Trump and Carroll are likely to persist.

Complexities of New York's Legal Definitions

The case has also highlighted complexities within New York's legal system. Judge Kaplan's commentary on the state's definition of rape shed light on the differences between legal terminology and modern societal understanding of sexual offenses. The narrower language in New York's penal code means that certain actions, while grievous, may not meet the legal criteria for rape in the state.

As Trump and his legal team brace for ongoing appeals, public interest in the implications of this case remains strong. The scenario underscores the significance of legal definitions in determining the outcomes of high-profile cases.

This decision by the appeals court signifies an important moment for Carroll, who has fought a long legal battle against Trump. Her allegations and the subsequent lawsuit were met with skepticism by some and became a focal point in broader discussions about sexual violence and accountability.
