Before he was elected, President Joe Biden used to support safeguards for the American government. Now that it’s his party that would benefit from packing the U.S. Supreme Court, he’s singing a different tune.
Back in 1983, Biden was caught on camera calling court-packing “a bonehead idea” when speaking as a U.S. Senator, the Daily Caller reported. However, Democrats have been warming to the idea of adding more justices since it would tip the court in their favor — and Biden isn’t exactly shutting it down.
Last week, Biden signed an executive order to form a commission to examine whether adding four more justices to the existing nine on the court would be feasible. Currently, the court is 6-3 in favor of conservative, originalist judges. However, a proposal by Congressional Democrats Thursday sped past his commission with the legislative proposal to do just that.
Biden had promised to form the commission during the campaign. He attempted to side-step the issue by promising he would “put together a national commission — a bipartisan commission … and I will ask them to, over 180 days, come back to me with recommendations as to how to reform the court system … it’s not about court-packing.”
However, Biden outright denounced court-packing completely back when President Ronald Reagan attempted to replace U.S. Commission on Civil Rights members. He compared Reagan’s action to a proposal by President Franklin D. Roosevelt to add justices which ultimately failed.
“President Roosevelt clearly had the right to send to the United States Senate and the United States Congress a proposal to pack the court,” Biden had said. “It was totally within his right to do that. He violated no law. He was legalistically, absolutely correct,” he said then.
“But it was a bonehead idea,” Biden charged. “It was a terrible, terrible mistake to make. And it put in question, if for an entire decade, the independence of the most significant body … in this country, the Supreme Court of the United States of America.”
It’s clear that Democrats want to add justices so the balance is in their favor. They want total control over all branches of government, including the judiciary. Arbitrarily adding justices to do that is a bonehead idea, but it’s too bad the Biden of yesteryear isn’t who is running the country today.
