Trump ally Steve Bannon has legal grounds that could overturn conviction

Former White House strategic Steve Bannon could seek to overturn his recent conviction.

Fox News contributor Gregg Jarrett published a new report on Bannon's case and how to change its outcome.

The situation

“Even U.S. district court judge Carl Nichols recognizes that Bannon’s contempt conviction is likely to get tossed out, which is why he took the extraordinary step of issuing a stay of sentence pending appeal," Jarrett wrote.

"When Bannon was subpoenaed by the J-6 Committee, Trump’s lawyer sent him a letter stating that the president invoked executive privilege and therefore directed him not to testify. Trump holds the privilege, not Bannon. Under law, Bannon cannot waive it or violate it. So, on advice of his own counsel, Bannon declined to testify. It was the correct advice,” he added.

The battle

"We may have lost the battle here today, but we are not going to lose the war," he said, adding: "I stand with Trump and the Constitution (of the United States) and I will never back off that."

"The prosecution had argued Bannon wilfully ignored clear and explicit deadlines given to him to appear, but his defence claimed throughout that he believed those details had been 'flexible and subject to negotiation,'" Sky News reported in July.

Bannon was found guilty of two counts of criminal contempt that had a maximum penalty of one year each. He received four months instead but has avoided jail time as he is appealing the case.

The case became the first successful attempt to prosecute a person for contempt of Congress since a conspirator was prosecuted during the Watergate scandal with President Richard Nixon in 1974.

The charge came after he refused to comply with a subpoena by the House committee investigating Jan. 6, 2021.

Now his guilty verdict is showing potential to be overturned as the committee's work wraps up and Republicans take back power in the House.

It will be interesting to see whether Bannon wins his appeal or whether he'll actually serve time in prison for his contempt of court conviction.
