Now that it’s clear the Supreme Court could overturn Roe v. Wade, Democrats are relishing the chance to shine a spotlight on their pet cause of abortion. However, the real story reveals a major shift in the way things are done.
A leak of a draft opinion on a case that could overturn nearly half a century of legalized abortion in America has upended Washington, D.C., The Hill reported. Many experts are predicting that it will further undermine public faith in the court.
The draft opinion, written by Justice Samuel Alito, would not outlaw abortion outright if it becomes law. Instead, it would return the issue to the states where it was legislated prior to the landmark decision.
Republican lawmakers were most outraged by such an unprecedented breach in security from the court. “This lawless action should be investigated and punished to the fullest extent possible, the fullest extent possible,” Senate Minority Leader Mitch McConnell (R-KY) urged Tuesday.
“If a crime was committed, the Department of Justice must pursue it completely,” McConnell further stated. Chief Justice John Roberts has ordered the marshal of the Supreme Court to find the source of the leak.
“This was a singular and egregious breach of that trust that is an affront to the Court and the community of public servants who work here,” Roberts said in a statement. It’s unclear whether the leak was criminal, but it certainly speaks to a broader problem with the court.
“It exacerbates the declining respect that Americans have for the court,” University of Richmond law professor Carl Tobias told the news outlet about the leak. “This cannot be good for its relationship with the public.”
Regardless of the noble merits of Alito’s argument and what it means for the unborn, the main issue at hand is that this leak occurred in the first place. These kinds of politically motivated antics undermine every institution where they happen.
