Supreme Court asked to stop Biden student loan bailout

A Wisconsin legal group has filed an appeal to the Supreme Court to postpone the Biden administration's plan to forgive student loan repayments for many Americans.

The challenge from Wisconsin Institute for Law & Liberty argues the move is unconstitutional and will significantly add to the national debt.

"The blow to the United States Treasury and taxpayers will be staggering — perhaps costing more than $1 trillion. If this program goes forward as planned on Sunday, then the president will unilaterally spend roughly 4% of the nation's Gross Domestic Product," the request said.

"There is no legal justification for this presidential usurpation of the constitutional spending power, which is reserved exclusively for Congress," it added.

The emergency request is one of many legal challenges to the student loan forgiveness plan, but it is the first to head to the Supreme Court.

The case will be interesting as it will force the court to weigh in on whether the president can move forward with the action or will be required to pass the plan through Congress.
