Supreme Court Justice Brett Kavanaugh joined the liberals in the court in a case that could force Navy SEALs who refused to be vaccinated to be removed from military service.
“I concur in the Court’s decision to grant the Government’s application for a partial stay of the District Court’s preliminary injunction for a simple overarching reason: Under Article II of the Constitution, the President of the United States, not any federal judge, is the Commander in Chief of the Armed Forces,” he wrote in his ruling.

The case involves 35 Navy SEALs who could be removed from service involved in the lawsuit.
For now, the court has issued a stay in the injunction, meaning the Navy can consider vaccination status as the case continues.
The SEALs believe the vaccine mandate is in violation of their First Amendment right of religious freedom.
