Grand jury decides not to indict man accused of throwing White Claw at Sen. Cruz

Fox News reports that a grand jury has decided not to indict the man accused of throwing an unopened alcoholic beverage at Sen. Ted Cruz (R-TX). 

In case you missed it, the incident took place in November, and it was caught on video. Take a look:

The video shows Cruz participating in a parade that took place after Major League Baseball's (MLB) Houston Astros won the World Series last year. Cruz, in the video, is standing on the back of a truck that is participating in the parade. Others who were with Cruz, presumably his security detail, can be seen pointing at someone in the audience that is gathered along the streets.

Then, an unopened alcoholic beverage can is launched at Cruz's face. The can is blocked by Cruz's security, preventing it from hitting Cruz in the head. The can, however, does hit Cruz in the neck and chest, although the impact was not enough to cause Cruz any serious injuries.

Then, the video ends with security looking to apprehend the responsible individual.

"As always I'm thankful for the Houston Police and Capitol Police for their quick action," Cruz said after the incident. "I’m also thankful that the clown who threw his White Claw had a noodle for an arm."

The suspect was identified as 33-year-old Joseph Halm Arcidiacono. He was charged with aggravated assault with a deadly weapon.

"I know, I’m an idiot. I’m sorry," he allegedly told the officer who arrested him.

Arcidiacono's attorney subsequently released a statement, saying, in part:

What happened at the parade was not political violence nor "aggravated assault with a deadly weapon." We have seen various videos and understand why Senator Cruz's security detail was alert for potential violence. Instead, this was an Astros fan trying to toss drinks from his cooler to the Senator during a championship parade and not realizing how it would be perceived until he saw security's reaction.

Many have called this reading of the event into question considering the velocity and aim of the unopened can. But, a grand jury has apparently bought into Arcidiacono's defense.

The latest reports indicate that the grand jury has declined to indict Arcidiacono. Instead, it no-billed him.

This essentially means that the grand jury does not believe that there is sufficient evidence to indict Arcidiacono.

Cruz has yet to respond to the grand jury's decision.
