Florida health agency files FOIA requests for info on Biden's 'gender affirming care' policies

Florida, under Gov. Ron DeSantis, has fast become one of the most protective states of children when it comes to "gender-affirming care," or gender transitioning procedures. 

According to the Daily Wire, the state's health agency, the Florida Agency for Healthcare Administration (AHCA), has filed Freedom Of Information Act requests to obtain documents from the Biden administration for the official policies related to the medical procedures performed on children.

The Daily Wire noted: "The AHCA submitted Freedom of Information Act (FOIA) requests to both the Department of Justice (DOJ) and Department of Health and Human Services (HHS) asking for documents on the Biden administration’s transgender health care policies."

The documents sought by the agency are specifically concerning the Biden administration's policies on the subject for the state of Florida.

The Daily Wire noted in an exclusive report: "The AHCA is currently the defendant in a lawsuit over a state rule that prevents Medicaid funds from going toward “gender-affirming” care, which includes hormone therapy and sex reassignment surgery."

The documents requested from the Biden administration reportedly officially say that sex reassignment surgeries "lack the evidence to be considered effective treatments for gender dysphoria, particularly for children," the DC noted.

If obtained, those documents could be all the ammunition needed for the agency to prevail in its lawsuit.

The Florida agency also sought similar records from any discussions Biden's White House had on the topic with the American Academy of Pediatrics, the Endocrine Society or the World Professional Association for Transgender Health.

According to The Hill, earlier this month, a Florida judge ordered the state's AHCA to turn over "documents related to its determination that gender-affirming health care cannot be covered under Medicaid because treatments are 'experimental and investigational.'"

The judge gave the state agency until Feb. 14 to produce the requested documents, which "among other documents, its communications with experts that were used to inform the agency’s June report on gender-affirming health care and the ensuing rule that excluded treatments from Medicaid."

Litigation on the issue appears to be in full swing.

Only time will tell if Florida can take the U.S. government to task on the issue, but given DeSantis' string of victories and rising popularity as a leader who gets things done, it wouldn't be a surprise if he prevails for the residents of his state.
