Judge Andrew Hanen of Texas ruled Friday that the Deferred Action for Childhood Arrivals (DACA) program violated federal statutes, according to Breitbart News.
The judge ruled that former President Barack Obama made a unilateral move when he put the program in place and provided illegal amnesty to hundreds of thousands in the process. Hanen’s ruling essentially shuts down DACA by blocking the government from allowing new applicants to the program.
“DHS violated the [Administrative Procedure Act] with the creation DACA and its continued operation … the DACA Memorandum and the DACA program that it created are hereby vacated and remanded to DHS for further consideration, as requested,” Hanen writes.
“DHS … is hereby enjoined from approving any new DACA applications and granting the attendant status,” Hanen continues.
This ruling is at an advantageous time for the Biden administration who had planned to not only expand the DACA program in the coming months but grant amnesty for participants according to Breitbart News.
Hanen’s ruling could provide much-needed safety for Americans however. According to a separate report, more than 2,100 DACA illegal aliens had been ejected from the amnesty program for having committed crimes here in the United States.
Biden’s decision to push for an expanded DACA program is especially troubling in light of his administration’s recent decision not to accept refugees from Cuba or Haiti.
The administration’s decisions making on foreign immigration has Republicans left to wonder if who is offered admission to the country might be based more on who those immigrants might vote for rather than their genuine status of need.
