The revelation of the Supreme Court’s forthcoming decision to overturn the Roe v. Wade decision rankled pro-abortion activists. However, the real outrage should be at how this news was spread.
The Justice Department could be tasked with finding the source of a leak from the high court, the Washington Examiner reported. A draft of Justice Samuel Alito’s opinion published Monday night indicated the court may overturn two key decisions that enshrined abortion as a right.
“This lawless action should be investigated and punished as fully as possible,” Senate Minority Leader Mitch McConnell (R-KY) said Tuesday while calling on the DOJ. Chief Justice John Roberts has also initiated a probe into the matter through the Marshal of the Court.
However, Edinburg, Texas, attorney Omar Ochoa thinks the leaker may not be charged with a crime. “There are certain agencies where disclosure of confidential information is actually a crime, like national security information, but I’m not aware of anything like that in the Supreme Court in terms of disclosing confidential information,” he told the Washington Examiner.
This leak “does not appear to be criminal” without evidence that there was a financial incentive or malicious intent, so the most that would happen would be that the person — likely an attorney inside the court — would lose his or her job. “I think losing their employment would probably be the most straightforward outcome of the investigation if they were found out, but I think there’s also some potential for losing their license,” Ochoa said of the professional consequences.
The source of the leak remains unknown. However, Politico, which was the first to publish the draft online, said it came from a “person familiar with the court’s proceedings.”
The draft stated both the 1973 Roe v. Wade decision and the 1992 Planned Parenthood v. Casey “must be overruled.” Roberts has since authenticated the document though he stressed it was not an official final decision.
To finally overturn the bad case law that permitted abortion is a win for America. However, the news coming from an insider leak indicates that there is a problem with security at the high court.
