The motions panel concluded that Plaintiff's uncontested failure to make a showing as to the first factor set forth in Richey' is reason enough to conclude that the district court abused its discretion in exercising equitable jurisdiction here,'" the appeal states.
"Although the panel's determination related specifically to the documents bearing classification markings, it's reasoning arguably applies more broadly. If this Court agrees that the district court lacked jurisdiction, further proceedings before the special master and district court would end," it adds.

"DOJ officials are arguing that they must have access to unclassified material confiscated at Donald Trump's Mar-a-Lago residence and resort by the FBI earlier this month to better assess the classified — including top secret — files they're examining," HuffPost reported.
"They also need to examine all the records for possible clues as to how the documents may have been transported and accessed, officials said," it added.

The appeal will now have to be considered in an attempt to push the case ahead of the November midterms.
The Biden administration has already politicized the FBI with its raid. It is now doing something similar in its actions through the courts.
Trump's team continues to face attacks every step of the way as he fights back for a potential battle in the 2024 election.
