16 Attorney Generals sign letter stating Joe Biden's "assault weapons ban" is flagrantly unconstitutional

Attorney generals from 16 states sent a letter warning President Joe Biden that his proposed "assault weapons ban" is "unconstitutional," Townhall reported. Biden said he would outlaw these guns during his State of the Union address earlier this month.

On Feb. 7, Biden delivered his speech and used the case of Brandon Tsay, who was confronted by a gunman at his dance studio, to push his agenda.  The 26-year-old managed to wrestle the gun away from a would-be shooter who had already killed 11 others at another dance studio.

"He saved lives. It’s time we do the same as well," Biden said. "Ban assault weapons once and for all," the president said.

However, Biden's effort to take guns away from law-abiding citizens won't go unchallenged, according to the attorneys general who sent the letter. The effort was led by Montana's Attorney General Austin Knudsen and called Biden out for his "irresponsible and unconstitutional demand that Congress ban firearms commonly used by law-abiding Americans for self-defense."

Other states' attorneys included those from Alaska, New Hampshire, West Virginia, Arkansas, Alabama, Kentucky, South Carolina, Iowa, Kansas, Mississippi, Idaho, Indiana, Wyoming, Texas, and Utah. "Last week, you called on Congress to ban so-called “assault weapons," the letter to Biden said.

"While you fail to define the very epithet you propose to ban, we know that is by design," the letter went on. "Anti-gun politicians like yourself use the misleading label of 'assault weapon' to scare Americans—expecting us to endorse your efforts to criminalize law-abiding gun owners," the attorneys continued.

"We also know that your personal definition of 'assault weapons' is staggeringly broad—encompassing all semiautomatic weapons—which are the most common and effective self-defense weapons in use today, employed by over 100 million Americans to defend their homes and families." The letter went on to quote Biden calling access to these guns "sick" during off-the-cuff remarks.

"According to estimates by the National Shooting Sports Foundation, there are at least 100 million semiautomatic handguns in the United States, the vast majority of which are lawfully possessed by law-abiding Americans exercising their God-given right of self-defense," the letter explained. "A semi-automatic pistol is the self-defense weapon of choice for the overwhelming majority of law-abiding gun owners."

"Moreover, Americans possess an estimated 45 million lawfully owned semiautomatic rifles in the United States," the attorneys continued. "Thus, when Americans hear that you plan to come after our so-called 'assault weapons' we brace ourselves for an attack on ordinary, safe, and highly effective weapons commonly used for self and home defense by over 100 million Americans."

The attorneys general then went on to point out that using Tsay as an example was "self-defeating" in that he was an unarmed law-abiding citizen facing an armed criminal. They also noted that the gun used against him was already illegal, negating Bidne's argument completely.

"According to your own CDC, Americans use guns to protect themselves and their families up to 3 million times per year, if not more—far more often than guns are used in crimes, and far, far more often than guns injure people." The letter also debunked another of Biden's claims..

"Your claim that the 1994 federal 'assault weapon' ban, which you supported in Congress, reduced mass shootings is also unsupportable," the letter pointed out. "Two different studies commissioned by the U.S. Department of Justice—during the Clinton and Bush Administrations—found no discernible effect on violent crime from that legislation."

"The right to keep and bear arms is one of the most fundamental and deeply rooted liberties in our constitutional tradition," the attorneys general continued. "It guards and protects the most basic of all rights, the right to life, and it stands as a constant bulwark against tyranny. We stand ready to oppose any attempt by your Administration to trample on this fundamental constitutional right," the attorneys general promised.

Biden will not have an easy time stripping Americans of their Second Amendment rights. These state attorneys are ready to mount a legal attack, but Biden and the Democrats are never deterred by something as trivial as legality.
